These Terms of Service ("Terms") govern your use of https://toppaintingremodeling.com (the "Site"), operated by FLTOP PAINTERS LLC ("we," "us" or "our"). By using the Site or submitting a request, you agree to these Terms. Please also read our Privacy Policy, which explains how we handle your information.

1. Who We Are

FLTOP PAINTERS LLC is a Florida limited liability company (document number L20000247180) with its principal address at 3716 Hatchery Way, Bradenton, FL 34211. Top Painting & Remodeling is the brand name of FLTOP PAINTERS LLC. Under that name we design and build custom fireplace walls, TV and media walls, built-in shelving and accent and feature walls, and take on kitchen and bathroom remodeling projects, for homes in Sarasota, Lakewood Ranch and nearby communities in Florida.

2. Eligibility

You must be 18 years of age or older to use this website, to submit a request, and to opt in to either of our text messaging programs.

3. Design Requests, Consultations and Proposals

• Requests submitted through the Site are requests for an in-home consultation. They are not a contract and do not reserve a date.
• We come to your home, look at the room with you and measure the wall. Then we bring your drawing and a written proposal that states the scope and the cost. Any figure discussed before the written proposal is approximate.
• Nothing gets built until you approve the drawing and sign the written proposal or contract. The terms that apply to your project are the ones stated in that document.

4. Your Right to Cancel

Under Florida Statute 501.025, you may cancel a home solicitation sale at any time before midnight of the third business day after the date of the transaction.

5. Text Messaging Programs

Text messages are sent by FLTOP PAINTERS LLC (Top Painting & Remodeling). We operate two separate, optional programs, and each one has its own unchecked box on the first step of our request form:

• Program 1: Design request and project updates. Messages about your design request, scheduling your in-home consultation, your drawing and written proposal, and project updates.
• Program 2: Project showcases and seasonal offers. Occasional marketing and promotional messages, such as new project showcases and seasonal offers, only if you check the second box.

• Message frequency. Message frequency varies.
• Cost. Msg & data rates may apply.
• Opt out. Reply STOP to any message to stop all text messages from us. You will receive one confirmation message and then no further text messages. Reply START to rejoin.
• Help. Reply HELP to any message for help, or contact us at (203) 628-5997 or office@toppaintingremodeling.com.
• Carriers. Carriers are not liable for delayed or undelivered messages.
• Not a condition. Consent is not a condition of any purchase.
• Age. You must be 18 or older to opt in.

6. Use of the Site

You agree not to use the Site to submit false information, to interfere with its operation, to attempt unauthorized access, or for any unlawful purpose. All content on the Site, including text, photographs of our work, drawings, and our name and logo, belongs to us and may not be copied or reused without our permission.

7. Photographs and Illustrations

Photographs in The Collection and on our project pages show walls built by our team. Some service pages use illustrations of a style; those images are marked as illustrations and do not show a completed project by our team. Results depend on the room, the materials selected and the scope agreed, and do not promise a specific outcome in your home.

8. Disclaimers

The Site is provided "as is." We do not promise that it will be uninterrupted or error free, or that the information on it is complete or current. Nothing on the Site is a promise about workmanship; the terms that apply to your project are the ones stated in your written proposal or contract.

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages arising from your use of the Site. Our total liability arising out of the Site will not exceed one hundred U.S. dollars. Nothing in these Terms limits our obligations under a signed proposal or contract with you.

10. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Florida.

11. Changes

We may update these Terms. The version posted on this page, with the "Last updated" date above, is the version that applies.
